This document establishes the terms of the Sale of our Services
Inday Tours SRL, added as a company to this document, always wants you to enjoy your trip with us to the fullest. The following conditions are within the Contract between Inday Tours SRL, and the Client (The Contractor). Please read all the documents carefully. When you book a tour with us, you agree to these conditions and terms, including Cancellations and our responsibilities. This agreement is based on our local laws. If there is any dispute, this will be subject to the jurisdiction of the local authorities.
The contract between Inday Tours SRL and the Client.
To secure a reservation with Inday Tours SRL, the Contractor must deposit 30% in advance.
All flight tickets must be purchased and paid for 100% at the time, as we do not ensure that they remain with the aforementioned rate or worse still that they run out of spaces for the required dates.
1. Payment
The balance must be paid at least 30 days before the start of your trip. If for any reason we reach an agreement of the payment upon the arrival of the client, it must be paid in 100% at least 1 day before the start of the trip in cash.
If for any case the balance is not fully covered by the indicated date, Inday Tours SRL will consider the reservation as canceled by the Contractor.
1.1 Payment Method
Payment can be made by your Credit/Debt card, VISA, MASTER CARD, DISCOVER, DINERS CLUB INTERNATIONAL and ELO can be accepted. Bank Transfer, we will send you all our necessary bank information, also you can pay with transfer through Western Union or Money Gram.
If the Contractor decides to purchase our services within 30 days in advance, he must pay 100% of the tour in a single payment.
All our prices are based on US Dollars
If for any reason the client decides to make a change to his previously agreed itinerary, he must cancel USD 10.00, as compensation for the arrangements made as long as they are possible, and pay some other amount to our local representatives for the changes made, if these apply.
2. Client Agreement
2.1 Substitution of Clients
If for some reason any member of the group is unable to make the trip, but he finds someone who can make his itinerary, just must cancel USD 50.00 for the changes made, as long as they are possible, and pay some amount to our local representatives for the changes made, if they apply.
2.2 Cancellation by the Client
The client can cancel his trip at any time, this must be in writing to Inday Tours SRL. However, you have to bear in mind that this will automatically generate penalties that are communicated at that time by Inday Tours SRL.
The deposit paid to reserve the trip is not refunded
Payments for air tickets, reservation of income of the Inca Trail, are not reimbursed. All other reservations canceled less than 45 days prior to the start of the trip are subject to the following table of penalties.
60 days and more before the start of the tour 50% of the total price (first payment + local payment)
59 – 30 days before the start of the tour 60% of the total price (first payment + local payment)
29 – 14 days before the start of the tour 90% of the total price (first payment + local payment)
Less than 14 days before the start of the tour 100% of the total price (first payment + local payment)
For all cases of reimbursement, you must subtract 5% for the process with the Credit/Debit card. Including some administrative expenses made by our suppliers.
3. Recommendation
We highly recommend purchasing Travel Cancellation insurance, that can help you a lot to cover cancellation charges in certain justified circumstances, however, the insurance does not cover Change of Ideas, for example.
4. Changes and Cancellations by Inday Tours SRL
Inday Tours SRL wishes to fulfill 100% all the commitment committed to all our clients, however, we are not exempt from suffering any mishap that forces us to make any charges to your itinerary or ultimately any cancellation. Inday Tours SRL, reserves all right to carry out the same.
If a major change is known to us at the time of booking, clients will be informed immediately. If a major change is necessary after the booking, Inday Tours SRL, will inform the clients as soon as reasonably possible.
When an important change is made, the client will have the choice to accept or change the arrangements, to buy any other available tour or cancel the tour and obtain a full refund excluding 5% for the use of the Debit/Credit card for the processing of taxes related to penalties.
An important change means, war, attempted war civil riots, endemic evils, pandemics, industrial disputes, terrorist activities, nuclear or natural disasters, fire or some adverse weather condition, technical or mechanical problems with transportation, changes made by the reorganization of the flight schedule by the airline, alteration of the airline due to the type of aircraft, or any similar event beyond the control of Inday Tours SRL.
For all reimbursements, 5% will be deducted for the use of the card, including expenses and penalties by our providers.
Inday Tours SRL, is not responsible for any charge in the event of a change, beyond its control, in the departure time of date of a tour, flight or other forms of transportation.
5. Surcharges
In case of price increase, Inday Tours SRL will absorb the price increase if the price increase is less than 2% of the total package price. If the increase is greater than 2%, the customer will be charged the difference.
6. Passport VISAs and Vaccines
It is the responsability of the client to carry a valid passport, it is recommended with at least 6 months of validity. Carry a valid Visa if necessary, be with the required biosecurity measures before visiting the country. The information on these aspects is important and provided in good faith, but in no way responsability on the part of Inday Tours SRL.
7. Age, Physical condition and Participation
All clients are expected to assess that their physical condition aligns with the requirements of the itinerary of their choice prior to booking. Travelers with pre-existing medical conditions are advised to consult with a healthcare professional before traveling on their chosen itinerary.
Minors unaccompanied by an adult or guardian (under 18 years old) cannot be accepted on tours operated by Inday Tours SRL, however, minors may be considered on the trip, provided they are accompanied by a parent or guardian accept full responsability for the minor.
7.1 Participation
Inday Tours SRL reserves the absolute right to reject a reservation at its discretion. Clients agree to accept the authority and decisions of Inday Tours SRL employees as well as those of the tour leaders and guides. If, in the opinion of such persons, the health or conduct of a Client before or after departure appears to jeopardize the safe, comfortable or happy progress of a tour, the Client may be excluded from all or part of the tour. In the case of poor health, Inday Tours SRL can make the arrangements it deems appropriate for clients to receive timely medical attention in a health center or where it is considered necessary.
7.2 Local Laws
All participants in our tours are expected to obey the laws and regulations of the countries to visit. Any breach will release Inday Tours SRL, from all obligations that could otherwise affect these booking conditions.
7.3 Illness/Disability
Anyone suffering from an illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of said condition at the time of booking and make arrangements for the provision of any medication of other treatment that may be necessary during the travel. Failure to make such disclosure will constitute a breach of these reservation conditions and therefore could result in the exclusion of said people from the tour, in which case all the money paid will be lost.
If the chosen vacations include a cruise or excursion or boat transfer of any kind, the Client must inform at the time of booking if he/she cannot swim. This will not prevent the Client from participating in the tour, but will allow Inday Tours SRL, to take additional precautions for the Client’s safety at appropriate times.
8. Claims
If the Client has a complaint about any of the tour arrangements, he must inform the tour leader or guide or if possible a representative of Inday Tours SRL, as soon as possible so that they can do everything possible to rectify the situation. Only if Inday Tours SRL is aware of any problems will they have the opportunity to fix things. This will allow us to remedy the situation or facilitate compensation.
If the problem remains unresolved, a written complaint must be submitted to Inday Tours SRL withing 28 days after the end of the holiday.
9. Flight Reservation
Inday Tours SRL will endeavor to ensure that all flight prices are the same at the time they were quoted, however the airlines reserve the right to modify or withdraw rates without prior notice. So once a deposit is paid on an airfare, a reservation is guaranteed to be made for you, but the fare is NOT GUARANTEED. The fare can only be guaranteed when the flight reservation has been paid in full and a ticket has been issued. Flight reservations are non-transferable.
The flight schedules provided by Inday Tours SRL, are for reference only and are subject to possible changes. The Costumer should check the schedules carefully after receiving them. Inday Tours SRL, will endeavor to inform the Client as soon as it has any news of any possible change.
Inday Tours SRL, is not responsible for any delay in your flight, whether this delay is caused by adverse weather conditions, the action of air traffic controllers, airport authorities or (local) governments, the reprogramming of the flight schedules by the airline, a mechanical failure, strike, industrial action of any other reason.
10. Our Responsabilities
We try to guarantee that the Final Itinerary that is sent to you a few days before your arrival is fulfilled as described, however, we make it clear that due to different circumstances we will not be able to fulfill the same as described.
Inday Tours SRL, acts only as an agent and under the legal conditions that, while exercising all possible precautions, is not responsible for injuries, illnesses, damages, losses, additional expenses, accidental delays of other irregularities that may be caused, since Either through intentional or negligent acts or omissions on the part of the companies or people that provide or participate in transportation, accommodation or other services related to the completion of the tour, or through natural disasters, social disorders or other causes.
